Exodus 21:1-36

1‘These are the laws you are to set before them:

Hebrew servants

2‘If you buy a Hebrew servant, he is to serve you for six years. But in the seventh year, he shall go free, without paying anything. 3If he comes alone, he is to go free alone; but if he has a wife when he comes, she is to go with him. 4If his master gives him a wife and she bears him sons or daughters, the woman and her children shall belong to her master, and only the man shall go free.

5‘But if the servant declares, “I love my master and my wife and children and do not want to go free,” 6then his master must take him before the judges.21:6 Or before God He shall take him to the door or the door-post and pierce his ear with an awl. Then he will be his servant for life.

7‘If a man sells his daughter as a servant, she is not to go free as male servants do. 8If she does not please the master who has selected her for himself,21:8 Or master so that he does not choose her he must let her be redeemed. He has no right to sell her to foreigners, because he has broken faith with her. 9If he selects her for his son, he must grant her the rights of a daughter. 10If he marries another woman, he must not deprive the first one of her food, clothing and marital rights. 11If he does not provide her with these three things, she is to go free, without any payment of money.

Personal injuries

12‘Anyone who strikes a person with a fatal blow is to be put to death. 13However, if it is not done intentionally, but God lets it happen, they are to flee to a place I will designate. 14But if anyone schemes and kills someone deliberately, that person is to be taken from my altar and put to death.

15‘Anyone who attacks21:15 Or kills their father or mother is to be put to death.

16‘Anyone who kidnaps someone is to be put to death, whether the victim has been sold or is still in the kidnapper’s possession.

17‘Anyone who curses their father or mother is to be put to death.

18‘If people quarrel and one person hits another with a stone or with their fist21:18 Or with a tool and the victim does not die but is confined to bed, 19the one who struck the blow will not be held liable if the other can get up and walk around outside with a staff; however, the guilty party must pay the injured person for any loss of time and see that the victim is completely healed.

20‘Anyone who beats their male or female slave with a rod must be punished if the slave dies as a direct result, 21but they are not to be punished if the slave recovers after a day or two, since the slave is their property.

22‘If people are fighting and hit a pregnant woman and she gives birth prematurely21:22 Or she has a miscarriage but there is no serious injury, the offender must be fined whatever the woman’s husband demands and the court allows. 23But if there is serious injury, you are to take life for life, 24eye for eye, tooth for tooth, hand for hand, foot for foot, 25burn for burn, wound for wound, bruise for bruise.

26‘An owner who hits a male or female slave in the eye and destroys it must let the slave go free to compensate for the eye. 27And an owner who knocks out the tooth of a male or female slave must let the slave go free to compensate for the tooth.

28‘If a bull gores a man or woman to death, the bull is to be stoned to death, and its meat must not be eaten. But the owner of the bull will not be held responsible. 29If, however, the bull has had the habit of goring and the owner has been warned but has not kept it penned up and it kills a man or woman, the bull is to be stoned and its owner also is to be put to death. 30However, if payment is demanded, the owner may redeem his life by the payment of whatever is demanded. 31This law also applies if the bull gores a son or a daughter. 32If the bull gores a male or female slave, the owner must pay thirty shekels21:32 That is, about 345 grams of silver to the master of the slave, and the bull is to be stoned to death.

33‘If anyone uncovers a pit or digs one and fails to cover it and an ox or a donkey falls into it, 34the one who opened the pit must pay the owner for the loss and take the dead animal in exchange.

35‘If anyone’s bull injures someone else’s bull and it dies, the two parties are to sell the live one and divide both the money and the dead animal equally. 36However, if it was known that the bull had the habit of goring, yet the owner did not keep it penned up, the owner must pay, animal for animal, and take the dead animal in exchange.

رفتار با غلامان

(تثنيه 15‏:12‏-18)

1«ساير احكامی كه بايد اطاعت كنيد، اينها هستند:

2«اگر غلامی عبرانی بخری21‏:2 يعنی «اگر کسی از عهدهٔ پرداخت قرض تو برنيايد و بدين ترتيب غلام تو شود…».‏ فقط بايد شش سال تو را خدمت كند. سال هفتم بايد آزاد شود بدون اينكه برای كسب آزادی خود قيمتی بپردازد. 3اگر قبل از اينكه غلام تو شود همسری نداشته باشد و در حين غلامی همسری اختيار كند در سال هفتم فقط خودش آزاد شود. اما اگر قبل از اينكه غلام تو شود همسری داشته باشد، آنگاه هر دو آنها در يک زمان آزاد شوند. 4ولی اگر اربابش برای او زن گرفته باشد و او از وی صاحب پسران و دخترانی شده باشد، آنگاه فقط خودش آزاد شود و زن و فرزندانش پيش او بمانند.

5«اگر آن غلام بگويد: من ارباب و زن و فرزندانم را دوست دارم و آنها را بر آزادی خود ترجيح می‌دهم، 6آنگاه اربابش او را پيش قضات21‏:6 يا «پيش خدا».‏ قوم ببرد و در حضور همه گوش او را با درفشی سوراخ كند تا از آن پس هميشه غلام او باشد.

7«اگر مردی دختر خود را به كنيزی بفروشد، آن كنيز مانند غلام در پايان سال ششم آزاد نشود. 8اگر اربابش كه آن كنيز را خريده و نامزد خود كرده است، از او راضی نباشد، بايد اجازه دهد تا وی بازخريد شود؛ ولی حق ندارد او را به يک غيراسرائيلی بفروشد، چون اين كار در حق او خيانت شمرده می‌شود. 9اگر ارباب بخواهد كنيز را برای پسرش نامزد كند، بايد مطابق رسوم دختران آزاد با او رفتار كند، نه به رسم يک كنيز. 10اگر خودش با او ازدواج كند و بعد زن ديگری نيز بگيرد، نبايد از خوراک و پوشاک و حق همسری او چيزی كم كند. 11اگر ارباب در رعايت اين سه نكته كوتاهی كند، آنگاه آن كنيز آزاد است و می‌تواند بدون پرداخت قيمتی، او را ترک كند.

قوانين مربوط به مجازات مجرمين

12«اگر كسی انسانی را طوری بزند كه منجر به مرگ وی گردد، او نيز بايد كشته شود. 13اما اگر او قصد كشتن نداشته و مرگ، تصادفی بوده باشد21‏:13 نگاه کنيد به يوشع 20‏:1‏-9.‏، آنگاه مكانی برايش تعيين می‌كنم تا به آنجا پناهنده شده، بست بنشيند 14ولی اگر شخصی، به عمد و با قصد قبلی به كسی حمله كند و او را بكشد، حتی اگر به قربانگاه من نيز پناه برده باشد، بايد از بست بيرون كشيده، كشته شود.

15«هر كه پدر يا مادرش را بزند، بايد كشته شود.

16«هر كس انسانی را بدزدد، خواه او را به غلامی فروخته و خواه نفروخته باشد، بايد كشته شود.

17«هر كس پدر يا مادر خود را لعنت كند، بايد كشته شود.

18«اگر دو نفر با هم گلاويز بشوند و يكی از آنها ديگری را با سنگ يا با مشت چنان بزند كه مجروح و بستری شود اما نميرد، 19و بعد از اينكه حالش خوب شد بتواند با كمک عصا راه برود، آنگاه ضارب بخشيده شود، به شرطی كه تمام مخارج معالجه و تاوان روزهای بيكاری مجروح را تا وقتی كه كاملاً خوب نشده بپردازد.

20«اگر كسی غلام يا كنيز خود را طوری با چوب بزند كه منجر به مرگ او گردد، بايد مجازات شود. 21اما اگر آن غلام يا كنيز چند روزی پس از كتک خوردن زنده بماند، اربابش مجازات نشود، زيرا آن غلام يا كنيز به او تعلق دارد.

22«اگر عده‌ای با هم درگير شوند و در جريان اين دعوا، زن حامله‌ای را طوری بزنند كه به سقط جنين او منجر شود، ولی به خود او آسيبی نرسد، ضارب هر مبلغی را كه شوهر آن زن بخواهد و قاضی آن را تأييد كند، بايد جريمه بدهد. 23ولی اگر به خود او صدمه‌ای وارد شود، بايد همان صدمه به ضارب نيز وارد گردد: جان به عوض جان، 24چشم به عوض چشم، دندان به عوض دندان، دست به عوض دست، پا به عوض پا، 25داغ به عوض داغ، زخم به عوض زخم، و ضرب به عوض ضرب.

26«اگر كسی با وارد كردن ضربه‌ای به چشم غلام يا كنيزش او را كور كند، بايد او را به عوض چشمش آزاد كند. 27اگر كسی دندان غلام يا كنيز خود را بشكند، بايد او را به عوض دندانش آزاد كند.

28«اگر گاوی به مرد يا زنی شاخ بزند و او را بكشد، آن گاو بايد سنگسار شود و گوشتش هم خورده نشود، آنگاه صاحب آن گاو بی‌گناه شمرده می‌شود. 29ولی اگر آن گاو قبلاً سابقهٔ شاخ زنی داشته و صاحبش هم از اين موضوع باخبر بوده، اما گاو را نبسته باشد، در اين صورت بايد هم گاو سنگسار گردد و هم صاحبش كشته شود. 30ولی اگر بستگان مقتول راضی شوند كه خون‌بها را قبول كنند، صاحب گاو می‌تواند با پرداخت خونبهای تعيين شده، جان خود را نجات دهد.

31«اگر گاوی به دختر يا پسری شاخ بزند و او را بكشد، همين حكم اجرا شود. 32اما اگر گاو به غلام يا كنيزی شاخ بزند و او را بكشد، بايد سی مثقال نقره به ارباب آن غلام يا كنيز داده شود و گاو هم سنگسار گردد.

33«اگر كسی چاهی بكند و روی آن را نپوشاند و گاو يا الاغی در آن بيفتد، 34صاحب چاه بايد قيمت آن حيوان را تماماً به صاحبش بپردازد و حيوان مرده از آن او باشد.

35«اگر گاوی، گاو ديگری را بزند و بكشد، صاحبان آن دو گاو بايد گاو زنده را بفروشند و قيمت آن را ميان خود تقسيم كنند، و هر يک از آنها هم می‌تواند نيمی از گاو كشته شده را برای خود بردارد. 36ولی اگر گاوی كه زنده مانده، سابقهٔ شاخ زنی داشته و صاحبش آن را نبسته باشد، بايد گاو زنده‌ای به عوض گاو كشته بدهد و گاو كشته شده را برای خود بردارد.
