Towns for the Levites

1On the plains of Moab by the Jordan opposite Jericho, the Lord said to Moses, ‘Command the Israelites to give the Levites towns to live in from the inheritance the Israelites will possess. And give them pasture-lands around the towns. Then they will have towns to live in and pasture-lands for the cattle they own and all their other animals.

‘The pasture-lands around the towns that you give the Levites will extend a thousand cubits[a] from the town wall. Outside the town, measure two thousand cubits[b] on the east side, two thousand on the south side, two thousand on the west and two thousand on the north, with the town in the centre. They will have this area as pasture-land for the towns.

Cities of refuge

‘Six of the towns you give the Levites will be cities of refuge, to which a person who has killed someone may flee. In addition, give them forty-two other towns. In all you must give the Levites forty-eight towns, together with their pasture-lands. The towns you give the Levites from the land the Israelites possess are to be given in proportion to the inheritance of each tribe: take many towns from a tribe that has many, but few from one that has few.’

Then the Lord said to Moses: 10 ‘Speak to the Israelites and say to them: “When you cross the Jordan into Canaan, 11 select some towns to be your cities of refuge, to which a person who has killed someone accidentally may flee. 12 They will be places of refuge from the avenger, so that anyone accused of murder may not die before they stand trial before the assembly. 13 These six towns you give will be your cities of refuge. 14 Give three on this side of the Jordan and three in Canaan as cities of refuge. 15 These six towns will be a place of refuge for Israelites and for foreigners residing among them, so that anyone who has killed another accidentally can flee there.

16 ‘“If anyone strikes someone a fatal blow with an iron object, that person is a murderer; the murderer is to be put to death. 17 Or if anyone is holding a stone and strikes someone a fatal blow with it, that person is a murderer; the murderer is to be put to death. 18 Or if anyone is holding a wooden object and strikes someone a fatal blow with it, that person is a murderer; the murderer is to be put to death. 19 The avenger of blood shall put the murderer to death; when the avenger comes upon the murderer, the avenger shall put the murderer to death. 20 If anyone with malice aforethought pushes another or throws something at them intentionally so that they die 21 or if out of enmity one person hits another with their fist so that the other dies, that person is to be put to death; that person is a murderer. The avenger of blood shall put the murderer to death when they meet.

22 ‘“But if without enmity someone suddenly pushes another or throws something at them unintentionally 23 or, without seeing them, drops on them a stone heavy enough to kill them, and they die, then since that other person was not an enemy and no harm was intended, 24 the assembly must judge between the accused and the avenger of blood according to these regulations. 25 The assembly must protect the one accused of murder from the avenger of blood and send the accused back to the city of refuge to which they fled. The accused must stay there until the death of the high priest, who was anointed with holy oil.

26 ‘“But if the accused ever goes outside the limits of the city of refuge to which they fled 27 and the avenger of blood finds them outside the city, the avenger of blood may kill the accused without being guilty of murder. 28 The accused must stay in the city of refuge until the death of the high priest; only after the death of the high priest may they return to their own property.

29 ‘“This is to have the force of law for you throughout the generations to come, wherever you live.

30 ‘“Anyone who kills a person is to be put to death as a murderer only on the testimony of witnesses. But no one is to be put to death on the testimony of only one witness.

31 ‘“Do not accept a ransom for the life of a murderer, who deserves to die. They are to be put to death.

32 ‘“Do not accept a ransom for anyone who has fled to a city of refuge and so allow them to go back and live on their own land before the death of the high priest.

33 ‘“Do not pollute the land where you are. Bloodshed pollutes the land, and atonement cannot be made for the land on which blood has been shed, except by the blood of the one who shed it. 34 Do not defile the land where you live and where I dwell, for I, the Lord, dwell among the Israelites.”’

レビ族の町

1次のことばも、ヨルダン川のほとりに広がるモアブ平原に野営している時、主がモーセに伝えたものです。 「それぞれの所有地から、幾つかの町と放牧地をレビ族に与えるよう、人々に命じなさい。 彼らにも住む場所と、牛や羊など家畜を飼う土地が必要となる。 町の城壁から外側に向かって回り四百四十メートルの範囲を放牧地としなさい。 そうすれば、町の中心から境界線までの距離は、東西南北とも八百八十メートルということになる。 レビ族に与える町は、過って人を殺した者が逃げ込める、避難用の六つの町のほかに四十二だ。 全部で四十八の町を、放牧地も含めて与えることになる。 町は、大きい部族からは多く、小さい部族からは少しというふうに、全土の各地から選ぶ。」

避難用の町

9-10 次もまた、主からモーセへの命令です。「カナンの地に入ったら、 11 避難用の町を幾つか指定するように言っておきなさい。過って人を殺した者がそこへ逃げ込むためだ。 12 そうすれば、被害者の家族も容易に復讐はできない。裁判で有罪と決まるまでは、たとえ人殺しでも死刑にはできない。 13-14 そのような町をカナンに三つ、ヨルダン川の東側に三つ、全部で六つ選びなさい。 15 イスラエル人だけでなく、外国人や旅行者でも、過って人を殺したときはいつでも、この町に逃げ込んでよい。

16 しかし、鉄の道具で人を打ち殺したときは明らかに殺人罪だから、犯人は死刑だ。 17 大きな石を使った場合も殺人罪で死刑。 18 たとえ木製でも武器を使ったら、やはり殺人罪とみなされる。 19 被害者のために復讐したければ、自分で手を下してもかまわない。犯人に出会ったら殺してもよい。 20 憎しみに燃えて物を投げつけたり、待ち伏せして襲いかかったり、 21 怒りに狂ってなぐりつけたりして人を殺した場合は、明らかに殺人罪だから、犯人を処刑してもかまわない。

22-23 しかし、過失の場合はそうではない。わざと物を投げたのでも、怒って石を投げたのでもなく、投げた本人が人に当てようなどとは夢にも考えず、人を殺そうと思ったわけでもないのに、たまたまそれが当たって人が死んだ場合は、 24 事故かどうかよく調べなさい。その結果によって、加害者を復讐者に引き渡すかどうかを決めるのだ。 25 事故だとはっきりしたら、加害者を保護しなければならない。その時の大祭司が死ぬまで、彼は避難用の町に住むことになる。 26 ただし、彼が勝手に避難用の町を出、 27 町の外で復讐者に殺されたときは別である。それは殺人罪にはならない。 28 大祭司が死ぬまで町の中にいなければならないのに、勝手に町を出たからだ。大祭司が死んだら、いつでも国へ帰れる。 29 このおきては永遠に変わらない。

30 殺人犯はみな死刑だが、証人が二人以上いる場合に限る。一人だけでは死刑にできない。 31 殺人罪には代償はきかない。必ず死刑に処せられる。 32 また、大祭司が死ぬ前に家へ帰りたいと保釈金を積んでも、避難用の町から出ることはできない。 33 こうして、自分たちの土地が汚れるのを防ぐのだ。殺人で流された血は土地を汚す。それをきよめるには、殺人犯を死刑にするしかない。 34 これから行く地は、わたしもいっしょに住むのだから、このようなことで汚したりしないよう、くれぐれも注意しなさい。」
